Mayor ng Negros,Occidental at 11 pa, pinakukulong ng sandiganbayan..
NAHAHARAP sa hanggang 9-na taong pagkabilanggo ang kasalukuyang at mga dating opisyal ng Canlaon City, Negros Occidental na hinatulan ng Sandiganbayan dahil sa mga kasong paglabag sa anti graft and corrupt practices act dahil sa pagkakasangkot sa P60-M loan deal.
Kabilang sa mga napatunayang lumabag sa Section 3(g) ng Anti-Graft and Corrupt Practices Act (Republic Act No. 3019) ay sina: Mayor Jimmy Clerigo, City Treasurer Luisa Luza, mga kasalukuyang miyembro ng Sangguniang Panglungsod (SP) na sina Diego Santiago, Jose Chubasco Cardenas, Aldin Avila at Mamerto Bermil, Jr., ganundin ang dating alkalde na si udith Cardenas ( dalawang bilang ng kaso), at mga dating miyembro ng Sangguniang Panlungsod na na sina Edgar Estampador, Roberto Bolo, Amado Delos Reyes, Pedro Montero at Wagner Bekim Cardenas.
Bukod sa pagkakulong, ang mga nabanggit na respondent ay pinagbawalan na rin na humawak ng anumang posisyon sa pamahalaan.
Nabatid na umutang ang grupo ni Clerigo, ng P60-M mula sa Development Bank of the Philippines (DBP) para sa livelihood projects ng mga kawani ng city hall
Nabatid rin ang nasabing pondo ay muling pinautang o re-loaned sa Canlaon City Government Employees Multi-Purpose Cooperative (CCGEMCO).
“As loan collateral, the accused gave DBP the unqualified authority and power to apply the loan guarantee against special savings deposit of the city, including its share in the internal revenue allotment. Effectively, “the situation was tantamount to assigning the full control of the city’s coffers to an entity that had nothing to do with the administration and management of the city”, ayon sa anti-graft court decision
Nakasaad sa 19-na-pahinang desisyon ng Sandiganbayan na ang pondo para sa priority projects at mga pangunahing pangangailangan mga taga-lungsod ay nalagay sa panganib nang ikompromiso ng mga respondent ang deposito sa DBP habang ang mga miyembro lamang ng kooperatiba ang nakinabang sa pondong inilipat CCGEMCO.
Binigyang pagkakataon ang mga respondent na mailatag ang kanilang mga depensa at mga ebidensiya ngunit hindi na binigyang merito ng anti-graft court.
“… lest the defense forget, the accused are being tried for a violation of the Anti-Graft and Corrupt Practices Act. By the nature of the offense, the acts complained of are those committed by the respondents while in the performance of official duty. As made clear in its Statement of Policy, the purpose of the law (R.A. No. 3019) is to repress certain acts of public officers and private persons alike which constitute graft or corrupt practices or which may lead thereto”, saad sa desisyon ng Sandiganbayan.
Napatunayan din ng Sandiganbayan na nagkaroon ng sabwatan ang mga akusado upang isagawa ang pagmamalabis sa kapangyarihan.
“conspiracy among the accused was clearly established” as “the city mayor and city treasurer’s contract of loan with the DBP was with the concurrence of the vice-mayor, and members of the Sanggunian”, paliwanag sa decision ng anti-graft court. (Diana Cruz)
